Service.
Acceptance
These Terms of Service ("Terms") govern your access to and use of showtimestudios.store (the "Site") and any orders placed through the Site. By visiting the Site, signing up for SMS marketing, or placing an order, you agree to be bound by these Terms. If you don't agree, don't use the Site.
Who you're contracting with
The Site and all products sold on it are operated by Matthew D Scaife, sole proprietor, doing business as Showtime Studios, based in Phoenix, Arizona, USA. References to "we," "us," "our," and "Showtime Studios" mean this entity.
Products and drops
Showtime Studios sells limited-edition apparel in periodic drops. Each drop has a fixed inventory disclosed at the product level and may sell out within minutes of launch. We do not restock sold-out drops. Where applicable, we offer a time-limited preorder window after sellout for made-to-order production at the same price, disclosed clearly at the time of preorder.
Orders, pricing, and payment
Order acceptance
An order is not confirmed until you receive an order confirmation email from us. We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, insufficient inventory, or violations of these Terms. If we cancel an order after charging your card, we'll refund the full amount within 5 business days.
Pricing and taxes
All prices are listed in U.S. dollars. Pricing displayed on the Site may not include applicable sales tax, which is calculated at checkout based on your shipping address. We reserve the right to change pricing at any time, though changes don't affect orders already placed.
Payment
Payment is processed by Shopify Payments and accepted payment processors (credit/debit cards, Shop Pay, Apple Pay, Google Pay). You represent that you're authorized to use the payment method you provide.
Pricing errors
If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any orders placed at that price and refund you in full.
Shipping
We ship within the United States only for Drop 001. International shipping availability for future drops will be announced separately. Standard shipping times are 3–5 business days from the day your order ships; orders typically ship within 3 business days of order confirmation, except during drop launch weeks when shipping may take up to 7 business days due to volume.
Risk of loss and title for products passes to you upon delivery to the carrier. Showtime Studios is not responsible for lost, stolen, or damaged shipments after the carrier confirms delivery; please contact the carrier for such claims.
Returns and refunds
All sales are final. Every Showtime piece is hand-distressed and treated as a unique item — no two are identical. We do not accept returns or exchanges except in the cases listed below.
Exceptions to the final-sale policy:
- Defective product — if your order arrives with a manufacturing defect (not to be confused with the intentional distressing), email us within 7 days of delivery with photos at hello@showtimestudios.store. We'll replace it if inventory allows, or refund you.
- Wrong item shipped — if you receive a different SKU than you ordered, contact us within 7 days. We'll arrange a return and ship the correct item or refund you.
- Order not delivered — if your tracking shows non-delivery after 30 days from ship date, contact us and we'll work with the carrier to investigate and refund or replace.
Intellectual property
All content on the Site — including the Showtime Studios name, logo, designs, photography, copy, and any other materials — is the property of Matthew D Scaife or licensed to us, and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any of our content without our prior written permission. Limited personal, non-commercial use is permitted (e.g., taking a screenshot to share with a friend), but you may not use any of our content to promote a competing brand, train an AI model, or otherwise commercially benefit without our consent.
User-generated content
If you tag us in social media posts (e.g., @showtimestudios on Instagram or TikTok) wearing or featuring our products, you grant us a non-exclusive, royalty-free, worldwide license to repost or reshare that content on our own channels and marketing materials, with attribution to your handle. You can revoke this license at any time by emailing hello@showtimestudios.store and asking us to remove specific reposts.
Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any portion of the Site, including the password-gated pre-launch area, by guessing passwords or exploiting technical vulnerabilities
- Scrape, harvest, or extract content or data from the Site for commercial purposes
- Use bots, scripts, or automation to place orders or engage with drop launches
- Resell our products at a markup, in commercial volume, on third-party marketplaces (e.g., GOAT, StockX, eBay) without our written permission. We reserve the right to cancel orders we reasonably believe to be reseller activity.
- Engage in any conduct that disrupts the Site or other users' experience
Disclaimers
The Site and all products are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Hand-distressed product means each unit varies in distressing pattern, hem shape, and finishing details. This is intentional and not a defect.
Limitation of liability
To the maximum extent permitted by law, Showtime Studios and Matthew D Scaife will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or any product. Our total liability for any claim arising out of or relating to these Terms or your use of the Site will not exceed the total amount you paid us for the product giving rise to the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Showtime Studios, Matthew D Scaife, and our service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your infringement of any third-party rights.
SMS marketing program
Program description and use cases
Showtime Studios operates an SMS marketing program ("Showtime Studios SMS") used to send recurring promotional and informational messages to opted-in subscribers. Use cases include: drop launch announcements, member early-access alerts (passwords, links), discount codes and limited-time offers, and post-purchase order updates. Message frequency is up to 3 messages per month, aligned with product drops.
Age requirement
You must be at least 18 years old to opt in to the SMS marketing program. By opting in, you represent and warrant that you are at least 18 years of age and are the subscriber or authorized user of the mobile phone number provided.
How to opt out
You can opt out of the SMS marketing program at any time by replying with any of the following keywords to any Showtime Studios SMS message: STOP, UNSUBSCRIBE, END, QUIT, or CANCEL. After opting out, you will receive one final confirmation message and no further marketing SMS messages. Opt-out is processed within 24 hours.
Message and data rates
Showtime Studios does not charge you for SMS messages. However, your mobile carrier may charge message and data rates according to your carrier plan. Contact your carrier directly with any questions about your plan's costs.
Carrier liability disclaimer
Carriers — including but not limited to AT&T, T-Mobile, Verizon, US Cellular, Sprint, Boost, Cricket, MetroPCS, and other regional and prepaid providers — are not liable for delayed or undelivered SMS messages. Delivery is not guaranteed.

Full SMS Terms
Complete terms governing the SMS marketing program — including detailed keyword lists, the privacy treatment of mobile information, and program changes — are available at showtimestudios.store/sms-terms and form part of these Terms by reference. You opt in only by submitting your phone number through a form on the Site that displays clear consent disclosure including the brand name, frequency, opt-out instructions, and message/data rate disclaimer.
Accounts
You do not need to create an account to browse the Site. If you place an order, your order details are processed through Shopify's checkout, which may create a Shop Pay account associated with your email address. Your Shop Pay account is governed by Shopify's own terms and privacy policy, not these Terms. You are responsible for maintaining the confidentiality of any login credentials you use on third-party services we integrate with.
Termination
We may suspend or terminate your access to the Site at any time, without prior notice, for any reason, including violation of these Terms, suspected fraudulent activity, reseller behavior, or harm to other users or to Showtime Studios. You may terminate your relationship with us at any time by opting out of SMS (reply STOP) and ceasing to use the Site. Sections that by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnification, Disclaimers, Governing Law, Arbitration, and any rights or obligations regarding payments owed — will survive.
DMCA / Copyright Infringement
Showtime Studios respects the intellectual property rights of others. If you believe content on our Site infringes your copyright, send a notice to hello@showtimestudios.store with the subject line "DMCA Notice" containing all information required under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the material claimed to be infringing, and its location on our Site (URL)
- Your contact information (address, phone, email)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, agent, or law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
Counter-notices following a takedown should also be sent to the same address with the subject line "DMCA Counter-Notice."
Third-party services and links
The Site integrates with and may link to third-party services and websites, including but not limited to Shopify, Shop Pay, GoHighLevel, Twilio, Meta (Facebook/Instagram), TikTok, Cloudflare, Vercel, and shipping carriers. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of those services is governed by their own terms and privacy policies.
Electronic communications
By using the Site, signing up for SMS, or placing an order, you consent to receive communications from us electronically — including emails, SMS messages, in-site notifications, and any required legal disclosures. You agree that all electronic agreements, notices, and disclosures satisfy any legal requirement that such communications be in writing.
Force majeure
We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemic, labor disputes, government action, manufacturer delays, shipping carrier failures, or internet/utility outages.
Notices
Any notice we are required to give you under these Terms may be delivered via email to the address you provided at checkout or signup, via SMS to the phone number you provided, or via a prominent notice on the Site. Notices to us must be sent to hello@showtimestudios.store and are deemed delivered upon our confirmation of receipt.
Assignment
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms freely, including in connection with a merger, acquisition, sale of assets, or by operation of law, without your consent.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver of any provision of these Terms is effective only if in writing and signed by us.
Feedback
If you send us feedback, suggestions, ideas, or proposals about Showtime Studios, the Site, or our products ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, modify, and incorporate the Feedback for any purpose without compensation or attribution.
Governing law and disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict of laws principles. Except as provided in the Arbitration section below, any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
Arbitration and class action waiver
Please read this section carefully — it affects your legal rights, including waiving your right to a jury trial and the right to bring claims as a class action.
You and Showtime Studios agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased — except for small claims court actions and intellectual property disputes — will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in Maricopa County, Arizona, or virtually if both parties agree. The arbitrator's decision is final and binding.
Class action waiver: You and Showtime Studios agree that any arbitration or court proceeding will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
Opt-out: You may opt out of this arbitration agreement by emailing hello@showtimestudios.store with the subject line "Arbitration Opt-Out" within 30 days of your first purchase. The opt-out applies only to the arbitration and class action waiver provisions; the rest of these Terms remain in full effect.
Modifications
We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced via SMS or email to subscribers and posted on the Site. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire agreement
These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and Showtime Studios regarding your use of the Site and supersede any prior agreements.
